Malam Mutum ne yake jin tsoron yin zina, kuma ba zai iya kubuta daga gare ta ba sai dashi, shin zai iya yin istimna’i saboda kwantar da sha’awa?

Wa’alaikumus salam Warahmatallahi Wabarkatahu
Malaman Malikiyya da Shafi’iyya sun tafi akan cewa Istimna’i haramun ne kuma a cikinsa akwai ladabtarwa. Kuma Hanafiyya sun ce: Ana kyamar haramta Istimna’i da hannu da makamancinsa ba tare da wani uzuri ba, saboda zancen Allah wanda ya daukaka: *(( Da wa’yanda suke kiyaye al-aurarsu, Sai dai akan matayen su ko abunda hannayensu na dama suka mallaka, To lallai su ba abun zargi bane)).*
Neman jin dadi baya halatta sai da mata ko baiwa. Haka kuma akwai bata ruwa a cikinsa, da motsar da sha’awa a inda ba mahallinta ba.
Amma idan aka samu wani uzuri kamar idan kubuta daga zina ya zama dole ta hanyar Istimna’i, kuma ya kasance gwauro ba shi da mata kuma ba ya da baiwa, ko kuma yana da mata amma baya da ikon kaiwa zuwa gare ta saboda wani uzuri to lallai (anan) Istimna’i wajibi ne saboda shi yafi cancanta.
Mawallafin Fathul-kadir yace: *To idan sha’awa ta rinjaye shi sai ya aikata Istimna’i saboda nufin kawar da ita ta hanyarsa ana fatan ba za’a yi masa azaba ba. Amma mazhabar Hanabila sun tafi akan cewa lallai Istimna’i da hannu ba tare da wata bukata ba haramun ne kuma akwai ladabtarwa a cikinsa*. Kuma a cikin wata riwaya daga Al-Imam Ahmad: *Lallai shi Istimna’i ana kyamar sa.*
Kuma idan Istimna’i ya kasance saboda tsoron zina ne to ya halatta kuma babu komai akansa, Kuma shi ne mazhabar.
Mawallafin Al-Insaf yace: *Da za’a ce Istimna’i wajibi ne a wannan hali da ya kasance yana da wata fuska kamar wanda yake cikin matsi(tsananin bukata).*
Kuma a cikin wata riwaya daga Al-Imam Ahmad cewa: *Lallai Istimna’i ana haramta shi ko da ana jin tsoron zina. Yace a cikin Al-Insaf: Ba’a halatta Istimna’i sai a lokacin lalura. Sa’annan yace: Kuma hukuncin mace game da Istimna’i kamar hukuncin Namiji ne.*
Kuma ya halatta mutum yayi Istimna’i da hannun matarsa wajen dukkan Malaman fikhu.
Kuma hakika Ibnul-Arabi Al-Maliki ya riwaito daga wasu Malamai sun ce: *Ko dama ace dalili ya tsayu akan halaccin Istimna’i, to mutum mai-mutunci zai kawar da kai daga gare shi saboda kaskancinsa.*
An tambayi Ibn Umar game da mommotsa al-aura, wato Istimna’i. Sai yace: *((Wannan shi ne mai aiki da kansa)).*
Kuma Ibnul-Arabi Al-Maliki ya tsananta inda yace: *((Dukkan Malamai sun haramta shi, kuma shi ne gaskiyar da bai kamata ayi ma Allah addini sai da shi))*.
Kuma wasu Malamai sun ce: *((Lallai shi mai yin Istimna’i kamar mai aiki ne da kansa, kuma Istimna’i wani sa6o ne wanda Shedan ya kirkiro kuma ya gudanar da shi a tsakanin mutane har ya zama abun magana. Kaico! Ina ma ace ba’a fada ba, Ko da ace dalili ya tsayu akan halaccinsa, wallahi Mutum Mai-mutunci zai kasance yana kawar da kai daga gare shi saboda kaskancinsa….
…… Kuma Istimna’i yana da raunin dalili, abun kunya ne ga mutum kaskantacce, to ina ga mutum mai-daraja?!*
Shaikhul-Islam -Allah ya jikansa- yace: An ruwaito daga cikin wasu sahabbai da tabi’ai cewa: Lallai sun yi rangwame game da Istimna’i idan akwai lalura. Misali; *Mutum ne yake jin tsoron yin zina, kuma ba zai iya kubuta daga gare ta ba sai dashi, ko kuma idan baiyi shi ba zai yi rashin lafiya. Kuma wannan shi ne zancen Ahmad da waninsa. Amma idan babu lalula to ban san wani wanda yayi rangwame game da Istimna’i ba*.
Kuma Al-Mubarakafuri -Allah ya jikansa- yace: *A cikin Istimna’i akwai cutarwa mai-girma akan meyin sa ta kowace hanya ya kasance.
Gaskiyar magana lallai Istimna’i haramun ne. Yinsa baya halatta koda da manufar kwantar da sha’awa ne, ko wata manufa ta daban. Kuma duk wanda ya halatta shi saboda kwantar da sha’awa to hakika ya gafala gafala mai tsanani, kuma bai lura da abun dake cikinsa na cutarwa ba.*
Wannan shi ne abunda nike dashi, kuma Allah wanda ya daukaka shi ne mafi sani.
